1. ACCEPTANCE OF TERMS

By accessing or using ThrowCheck ("Service"), operated by Paternal Path ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Paternal Path. By creating an account, uploading content, or using any features of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. SERVICE DESCRIPTION

ThrowCheck provides AI-powered biomechanical analysis of baseball pitching mechanics. Our Service uses computer vision and machine learning algorithms (including Google MediaPipe) to analyze uploaded video footage and generate risk assessments related to pitching injury probability.

The Service includes:

• Video upload and processing capabilities
• Pose detection and joint angle measurement
• Biomechanical risk scoring (0-100 scale)
• Identification of high-risk movement patterns
• Historical tracking and trend analysis (Pro and Team tiers)
• Data export and API access (Team tier)

4. NO GUARANTEES OF ACCURACY

While we strive for accuracy, we make no guarantees, warranties, or representations regarding the accuracy, reliability, completeness, or timeliness of any analysis, risk score, or output generated by the Service.

Factors that may affect accuracy include:

• Video quality, camera angle, and lighting conditions
• Limitations of pose detection algorithms
• Individual biomechanical variations not captured by our models
• Evolving scientific understanding of injury mechanics
• Differences between controlled and game environments

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

4A. ARTIFICIAL INTELLIGENCE DISCLOSURE

The Service uses artificial intelligence and machine learning technologies, including Google MediaPipe for pose estimation, to generate biomechanical analysis. AI-generated outputs are probabilistic estimates, not deterministic measurements. Results may vary based on video quality, camera angle, lighting conditions, and other factors. The AI models have not been clinically validated and should be interpreted as informational guidance only.

5. AGE REQUIREMENT

You must be at least 18 years of age to use the Service. If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms. By using the Service, you represent and warrant that you meet these age requirements.

6. SUBSCRIPTION AND BILLING TERMS

The Service offers three tiers:

• Free Tier: One free analysis, no payment required
• Pro Tier: $49 per month, billed monthly
• Enterprise Tier: $499 per month, billed monthly

Billing: All payments are processed securely through Stripe. By subscribing to a paid tier, you authorize us to charge your payment method on a recurring monthly basis until you cancel. Prices are subject to change with 30 days' notice.

30-Day Money-Back Guarantee: If you are not satisfied with the Service, you may request a full refund within 30 days of your initial subscription. Contact contact@throwcheck.com to request a refund. This guarantee applies only to your first month of subscription.

Cancellation: You may cancel your subscription at any time through your account settings or by contacting support at contact@throwcheck.com. Cancellations take effect at the end of the current billing period. No refunds are provided for partial months after the initial 30-day guarantee period.

Free Trial / Early Access: Promotional offers (such as early adopter discounts) are subject to specific terms communicated at the time of the offer and may be modified or terminated at our discretion.

7. INTELLECTUAL PROPERTY RIGHTS

The Service, including all software, algorithms, analysis methods, design elements, and content, is the proprietary property of Paternal Path and is protected by United States and international copyright, trademark, patent, and other intellectual property laws.

Your Content: Your videos are processed entirely in your browser. We never receive, store, or have access to your video content. No license grant is required because your content never leaves your device. You retain full ownership and control of all videos you analyze using the Service.

Restrictions: You may not copy, modify, reverse-engineer, decompile, or create derivative works based on the Service. You may not use the Service to develop competing products or services.

9. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Paternal Path, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any third-party rights.

10. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts.

11. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email (if you have provided one) or by posting a notice on the Service. Changes become effective 30 days after notification.

Your continued use of the Service after the effective date of modified Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must stop using the Service and cancel your subscription.

12. TERMINATION

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, including for violation of these Terms. Upon termination, your right to use the Service immediately ceases, and we may delete your account and data in accordance with our Privacy Policy.

13. MISCELLANEOUS

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Paternal Path regarding the Service and supersede all prior agreements.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

No Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
